As of January 25, 2016, Sudan's designation for Temporary Protected Status (TPS) has been extended by the Secretary of Homeland Security, Jeh Johnson, for an additional 18 months. This is due to the increasing armed conflict in Sudan preventing nationals from being able to go home safely. This newly designated extension is from May 30, 2016 to November 2, 2017.
What if you are currently a TPS Sudan beneficiary?
You must re-register during a provisional 60-day period from January 25, 2016 to March 25, 2106. The United States Citizenship and Immigration Services (USCIS) encourages beneficiaries to do this sooner rather than later.
Additionally, this 18-month extension is allowing those re-registering to apply for a new Employment Authorization Document (EAD). For those that apply within the current 60-day period and seek out a new EAD, will receive one with an expiration date of November 2, 2017. It is also understood that some individuals will not get their new EAD until after their current permits expire. The USCIS is therefore extending the current expiration date for TPS Sudan EADs from May 2, 2016 to November 2, 2016, providing an extra 6 months for beneficiaries to get their new work permits.
What if you have a TPS Sudan application that is still pending?
You do not need to submit a new Form I-821 if it is still pending. If you do have a TPS-related EAD and want a new work permit, you must submit:
- Form I-765, Application for Employment Authorization;
- The Form I-765 application fee; and
- Copy of the receipt that your initial Form I-821 is still pending.
USCIS will reject any application that is not properly accompanied by the appropriate fees or fee-waiver request. You can also locate more information regarding TPS for Sudan at uscis.gov/tps.
