Are you or someone you know a current beneficiary of Temporary Protected Status (TPS) under Syria’s designation? If you want to maintain your status from now until September 30th, 2019, you must reregister for it between March 5th, 2018 and May 4th, 2018 – a brief two-month window of opportunity.
The Federal Register and the United States Citizenship and Immigration Services (USCIS) website have each outlined reregistration procedures, including how to employment authorization documents can be renewed. Anyone who needs to reapply must submit a Form I-821, Application for Temporary Protected Status within the allotted time, or they are likely to have TPS revoked. While filing their Form I-821, applicants can also apply for an Employment Authorization Document (EAD) with the submittal of a completed Form I-765, Application for Employment Authorization; if this is not done at the same filing time, it can still be completed on its own later.
Any EAD issued by the USCIS through Syria’s designation at this time will expire on September 30th, 2019. Additionally, EADs that expire on March 31st, 2018 will be given a full 180 day extension, all the way to September 27th, 2018. This decision has been made in acknowledgement of the typical processing time related to a TPS reregistration application.
There are two unique eligibility requirements for TPS granted through Syrian designation:
- The applicant must have resided in the U.S. continuously since August 1st, 2016.
- The applicant must have been “continuously physically” present in the U.S. since October 1st, 2016.
(All other usual eligibility prerequisites still apply for TPS reregistration.)
Secretary of Homeland Security Kirstjen Nielsen released a statement at the end of January 2018 that Syrian TPS designation would continue based on preexisting assessments and the input of other governmental groups. The TPS extension for Syrian designation is not guaranteed to be renewed upon its conclusion. More reviews will be necessary to decide if it will be once again extended or if it will be ended until further notice, the Department of Homeland Security mentioned.
