Many of us understand the concept of the "last will and testament." However, do you know what the will should contain, what the terms are, and how they can benefit your family? The will is a legally binding document that dictates all of your wishes in the event of your passing. The courts will oversee that every facet of your will is carried out.
What Are the Legal Requirements?
First, you must assess the overall contents of your property and its value. You must name the beneficiaries of your property and assets. The law does require that you be "of sound mind." You may also wish to use your will to supplement or as a backup to a living a trust. Finally, you must sign the document with two witnesses presents.
A will requires the following:
Naming an executor to ensure that your wishes are carried out
Naming the guardians for your children, as well as their properties
Discussing how the debts, taxes, and other funds should be paid
Witnesses must be present during the signing of the will
You may wish to have the signing of your will notarized, although this is not necessarily a legal requirement; it may give you some peace of mind. Although creating a last will and testament are mandatory under the law, doing so can safeguard your interests. Otherwise, your assets will be distributed according to the laws of intestacy, and may not necessarily be in line with your personal wishes.
